1. Acceptance of Terms

By accessing or using Steel Cap Staffing ("we", "our", "us", or "the platform"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the platform.

2. User Accounts

2.1. To access certain features of the platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information.

2.2. You must provide accurate and complete information when creating your profile. You are responsible for keeping your details up to date.

3. Use of the Platform

3.1. Steel Cap Staffing is a blue-collar staffing platform connecting Job Seekers and Employers. Users agree to use the platform for lawful and legitimate purposes only.

3.2. Users shall not engage in any fraudulent, misleading, or harmful activities, including impersonation, spam, or exploitation.

3.3. You must not use the platform to solicit, harass, or exploit other users.

4. Privacy Policy

4.1. By using the platform, you agree to the terms of our Privacy Policy, which outlines how we collect, use, and disclose personal information. The Privacy Policy forms an integral part of these Terms and Conditions.

5. User Responsibilities

5.1. Employers are responsible for:

  • the accuracy of company information shared, including logos or any other visual or written representation of the company
  • the accuracy, legality, and fairness of job advertisements posted on the platform
  • compliance with all Federal and State legislation including, but not limited to, Fair Work, Anti-Discrimination, Privacy and Child Employment laws

5.2. Job Seekers are responsible for:

  • ensuring their profiles, resumes, and information provided are truthful, accurate, and not misleading
  • ensuring profile pictures are appropriate for a work-related platform. They must not contain offensive content, nudity, or misleading representations
  • compliance with all Federal and State legislation including, but not limited to, Fair Work, Anti-Discrimination, and Privacy laws

5.3. All users agree not to submit content that is offensive, discriminatory, illegal, or violates the rights of others.

5.4. Both Employers and Job Seekers are encouraged to report any users who breach these Terms and Conditions.

6. Fair Work and Legal Compliance

6.1. All users must comply with Australian Fair Work legislation, anti-discrimination laws, and all other applicable workplace laws. More information can be found on the Fair Work Ombudsman website — www.fairwork.gov.au

6.2. If a candidate is not an Australian Citizen or Permanent Resident, you are required to confirm their eligibility to work in Australia. You can do so by visiting the Australian Government Department of Home Affairs website and conducting a VEVO Check

6.3. Steel Cap Staffing is not responsible for ensuring compliance by either party. Users agree to independently verify that all employment engagements are lawful and appropriate.

6.4. If you are engaging apprentices or trainees, you must comply with relevant apprenticeship regulations in your state or territory. Employers are encouraged to familiarize themselves with eligibility, wage, supervision, and training obligations via the official Australian Apprenticeships portal — www.apprenticeships.gov.au

6.5. For Employers Hiring Minors: You must adhere to child employment laws in your state or territory and obtain necessary permissions or Working With Children Checks (WWCC) where required.

7. Working With Children Checks (WWCC)

Where roles involve individuals under 18, Employers must comply with mandatory background screening:

Employers must provide proof of compliance with WWCC laws upon request.

8. Under-18 Users

8.1. For Job Seekers Under 18: You must obtain explicit consent from a parent or legal guardian before creating an account or applying for work. We may request verification of consent at any time.

8.2. Steel Cap Staffing limits access and visibility of under-18 Job Seekers’ data and will take precautions to ensure safety and compliance.

8.3. For Employers: If you intend to hire someone under 18, you must ensure:

  • That the job is legally appropriate for a minor in your jurisdiction.
  • That you have the necessary permissions (including parental consent, WWCC, and working hour restrictions compliance).

9. Intellectual Property

9.1. The platform and all original content, features, and functionality are the property of Steel Cap Staffing and are protected by copyright and intellectual property laws.

9.2. Users retain ownership of their content but grant Steel Cap Staffing permission to use, display, and distribute it on the platform.

10. Termination

Steel Cap Staffing reserves the right to suspend or terminate accounts that violate these Terms and Conditions, applicable laws, or the safety of the platform and its users.

11. Changes to Terms

We may modify these Terms and Conditions at any time. Continued use of the platform constitutes acceptance of the updated terms. Users are responsible for reviewing the Terms regularly.
